ABOUT THESE TERMS What these terms cover: These are the terms and conditions relating to the products and services we provide to you.

Why you should read them: Please read these terms and conditions carefully before you create an account with us. These terms and conditions let you know who we are, how we will provide our service, how you and we may change or end the contract, what to do if there is a problem and other important information.

Right to amend these terms: We reserve the right to change these terms and conditions from time to time, and your continued use of the website and our services following such a change shall be deemed to be your acceptance of such change. It is your responsibility to regularly check to determine whether the terms and conditions have been changed. If you do not agree to any change to the terms and conditions then you must stop using the website immediately.

WHO WE ARE AND HOW TO CONTACT US Who we are: Nythu is an online wedding gift list service run by Elen Bonner, trading as Nythu. Our office is based at Bryncir Home Farm, Golan, Garndolbenmaen, Gwynedd, LL51 9AQ.

How to contact us: If you would like to know more about the products or services we provide, or if you have any questions, you can email us at elen@nythu.co.uk or use the contact form on our contact page. You can also call 07896 053390. (Please refer to your service provider for call charges.) If we are not able to take your call, please leave a message and we will get back to you as soon as we can.

How we may contact you: If we need to contact you we will do so by telephone or by writing to you at the email or postal address you provide to us when you register an account with us.

OUR SERVICE Availability of service: Our service is free to you (the couple) and your guests. By registering an account with Nythu you are confirming that you are 18 years or over and resident in the UK.

Creating an account: You will need to register an online account with us before you can create your gift list. To create an account, you will need to provide us with your name, your partner’s name, your address, your email address, your telephone number and the date of your wedding. You agree to keep your username and password relating to your Nythu account confidential at all times. You are responsible for all activities relating to your Nythu account.

In registering an account, you have accepted these terms and conditions, and this is the point where a contract is formed between us and you.

Summary of process: After registering an account with us here, you browse our homeware to compile an online list of gifts you would like. You can add a Gift Card to your list as an option for your guests, as well as mark items as ‘Group Gifts’, enabling multiple guests to contribute towards a single higher-value item.

You share your list with your wedding guests by enclosing a small notification card (provided by us) with your invitations, discreetly advising guests where you have placed your wedding list. Alternatively, you can arrange independently to include details of how guests can access your gift list on your own invitations.

Your guests buy gifts for you from your gift list via the Nythu website. The monies that your guests have used to buy these gifts are monies pledged. You can use monies pledged to purchase any of the gifts from your list, and you have the flexibility to substitute items and consolidate your list before placing your final order.

Once you have placed an order for the gifts you would like, we will start the process of getting these gifts to you. Many of our products are made to order and as such have longer lead in times. We will contact you with a proposed a delivery schedule.

Once your gifts have arrived, you can begin to enjoy them every day.

Compiling your list: You will choose from a carefully curated range of homewares made by independent craftspeople from Wales and the UK. As a rule of thumb, the more gifts you add to your list the better. We advise at least two gifts per wedding invitation. Remember that you can ‘Hide’ gifts from guests and only make them visible if you feel that guests need more choice.

Try to offer a range of gifts across different price brackets for your guests to choose from. You can mark items are ‘Group Gifts’ enabling guests to contribute towards a higher priced gift. You can also highlight ‘Priority Gifts’ so guests are aware of your preference. Choosing a gift for you should be an enjoyable experience for your guests too.

We advise you to compile your list no more than twelve weeks before your wedding to make sure your are choosing from the most current ranges. If a product is discontinued before you have placed your order, we will remove the item from your list. We will let you know when this happens, and suggest that you add an alternative item. If, for whatever reason, an item becomes unavailable after you have placed your order, you have the option to substitute this item or have the equivalent value credited to your account. If this becomes necessary, we will contact you to discuss your preferred option, but we will not inform the guest who purchased the item. Items substituted in this way cannot be returned unless found to be faulty, not as described or not fit for purpose.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Please note however that many of the items we offer are handmade, and so there may be slight variations between products – we hope you agree that it’s part of what makes them special. From time to time, we may need to adjust the price of an item. If you have added an item to your list, we will honour that original price whilst the item is on your list. If you remove the item, and then wish to add it again, the item will be added at its updated price.

In addition, there may be inconsistencies in how different computer screens reproduce colours and so although we take great care with our product photography to make sure that we are providing you with pictures that accurately and fairly represent the products we sell, we cannot guarantee that the product you receive will look exactly the same as you see on your computer screen.

Nythu Gift Card: As well as products, you are also able to add a Nythu Gift Card option to your gift list that guests are able to pledge monies to. All gift card pledges will be credited to your account and are only redeemable at nythu.co.uk against product gifts and cannot be exchanged for cash.

Group Gifts: You are able to mark higher value items as ‘Group Gifts’, giving your guests the option to make contributions towards these products.

Should the full amount needed to purchase the item not be fully pledged by your guests, you will receive the partial value of what has been pledged in your Nythu account. You have the option of topping this amount up yourself to the full amount of the item or using the partial pledges to purchase other Nythu products.

Sharing your list: We will provide you with small notification cards to be enclosed with your invitations, discreetly advising guests where you have placed your wedding list. These cards are bilingual (Welsh/English) as standard. Once you have ordered your cards from us, please allow up to 10 working days for delivery. Alternatively, you can arrange independently to include details of how guests can access your gift list on your own invitations. The information required including your unique code and URL are available from your Nythu account.

Guest purchasing: Guests will be able to purchase from the list whilst it is live. It is your responsibility to publish your list prior to your wedding and to close it afterwards. You should aim to publish your list by the time you send out your notification cards so that guests are able to easily find your list. Guests will not be able to purchase items from your list if it has not been published. You are able to publish or un-publish your list at any time via your Nythu account. You must close your list and place your order no more than four weeks after your wedding date.

The principal and most convenient way for guests to shop from the list is online via nythu.co.uk If this is not convenient for any of your guests, we will endeavor to offer an alternative arrangement where reasonably possible. This alternative service is offered at our discretion, on a case-by-case basis, and cannot be guaranteed.

Guest cancellation rights: Please be aware that, under the Consumer Contracts Regulations 2013, each guest has the right to cancel their purchase of a gift made online or by phone, if they notify us no later than 14 days after the day you receive the gift.

This right to cancel does not apply to items that have been personalized or made to order, or to credit that has already been spent by you, the couple.

If a guest exercises their right to cancel after their gift has been dispatched, you must return the gift to us and must have taken reasonable care of the gift. It is the guest's sole responsibility to arrange and bear the cost of the return of the gift and we accept no responsibility for organising this with yourself or the guest.

Placing your order: All monies pledged by your guests are credited to your account. You can use monies pledged to purchase any of the gifts from your list, and you have the flexibility to substitute items and consolidate your list before placing your final order. (Please note that if you choose to substitute an item purchased by one of your guests, our liability to them under the Consumer Contracts Regulations 2013 is discharged.)

You are required to place your final order online no more than four weeks after your wedding day. You are permitted to leave no more than £50 in your account to spend at a later date. Once your balance is zero, you can request to disable your account via your account log-in. (Note that you cannot disable or close your account whilst it is in credit, and that by closing your account you forfeit our offer of 10% lifetime discount on Nythu purchases).

Although we hold some items in stock, most of our products are made to order by independent craftspeople especially for you. Once you have placed your order, we will commission the relevant maker who will provide us with a lead-in time. We will collate this information from all makers and provide you with a proposed delivery date(s).

Payment: You are able to add credit to your account, and also to purchase goods from Nythu after you have placed your final order.

Nythu uses “Paypal Express Checkout” to ensure the secure processing of such payments.

Payment will be taken at the time of purchase. You will receive an order confirmation via email.

All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products purchased. Payment can be made by any of the following methods:

- American Express
- Maestro
- Master Card
- Paypal
- Visa

If you are shopping from outside the U.K. your credit card company will convert the transaction to your own currency.

You confirm that the card being used is issued to and held by you.

All cardholders are subject to validation checks and authorisation by the card issuer. If the card issuer refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery of the gift(s) to the couple.

Refusal of transaction: We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of so refusing or by reason of unwinding or suspending any transaction after processing has begun.

Delivery: As noted above, many of our items are made to order and as such lead in times can vary depending on the nature of the craft. For this reason, we offer two complimentary deliveries Monday - Saturday within mainland UK as standard (so that you receive items available soonest - sooner, and the items available latest – later). Once we have received lead in times from all makers, we will contact you with a proposed delivery schedule. Additional deliveries or those requested at a specific time, as well as deliveries outside mainland UK are offered at our discretion and are likely to incur additional charges. Please contact us to discuss your preferred options.

We normally use a carrier to make delivery on our behalf; only your relevant details will be shared for the purposes of arranging delivery. You must take delivery within eight weeks of the items being available for delivery.

We'll securely pack (but not gift wrap) gifts to ensure they arrive safely at their destination. If you notice that any items are damaged or missing, please notify us as soon as possible within two weeks of delivery so we can help sort out any issues.

You must be available to accept delivery of your gifts on the agreed delivery date. If you fail to take delivery of the gifts or if you fail to give us adequate delivery instructions (otherwise than by reason of any cause beyond your reasonable control or by reason of our fault) then, without limiting any other right or remedy which may be available to us, we may store the gifts until actual delivery and charge you for the reasonable costs (including insurance) of storage. Any subsequent delivery attempts may incur additional charges.

We will not be responsible for any losses, costs, damages or charges that you may suffer if we delay in supplying or do not supply those products.

Product returns and cancellations: We hope that you will be happy with the gifts you receive, particularly as you are offered the opportunity to consolidate your list before placing your final order. As such, we do not offer returns on items purchased via your wedding gift list if you have changed your mind.

If the item is faulty, not as described, or does not do what it is supposed to do, please contact us within 30 days for a full refund. Where this is the case, we will reimburse standard return delivery charges.

If the product is personal in nature and the fault is the misspelling of the personalised information, which is as a result of your own actions, we will be unable to replace the product.

We securely pack gifts to ensure they arrive safely at their destination. If you notice that any items are damaged or missing, please notify us as soon as possible within two weeks of delivery so we can help sort out any issues.

You may request a return via the Product Returns form, which can be accessed from your Nythu account.

If you need to cancel your gift list for any reason please ‘Un-publish’ your list immediately and let us know in writing. We will then discuss how you would like your list to be dealt with. Please note that if you require us to refund guests, an administration charge may apply to cover costs incurred by us.

This does not affect your statutory rights.

Once you have placed your final wedding gift list order, you will become a Lifetime Customer.

Your cancellation rights under the Consumer Contracts Regulations 2013: As a Lifetime Customer you are entitled to cancel your contract with us if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the item.

Please note that your right to return products does not apply to items that are personalised or made to order.

To exercise the right to cancel, you must inform us of your decision to cancel the contract via the Product Returns form, which can be accessed from your Nythu account. If you decide to cancel, we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied. It is your sole responsibility to arrange and bear the cost of the return of the item. If the item is faulty, not as described, or does not do what it is supposed to do, please contact us within 30 days for a full refund. Where this is the case, we will reimburse standard return delivery charges.

PROMOTIONS Your 10% lifetime discount on Nythu products: We are delighted to offer all couples who use our gift list service a lifetime discount of 10% on future Nythu purchases once you have placed your final wedding gift list order. You must keep your Nythu account enabled in order to avail of this offer. This offer may exclude particular items from time to time and is not applicable to gift cards. We reserve the right to withdraw this offer at any time, without notice.

Fledgling couples: Fledglings are couples who have signed-up to pilot the Nythu service prior to its official launch in October 2019. As a Fledgling couple, you are pioneers – we ask that you communicate your experience with us so that we can make Nythu the best it can possible be. If you value our service, we also ask that you act as ambassadors for us within your communities and online. In return for your support during our soft launch phase, we’ll credit your account with £100 after you place your wedding gift list order.

Your wedding gift list order must exceed £1000 to qualify and you must retain your Nythu account in order to access the offer. This offer is subject to acceptance and is valid during our soft launch period only (ends 30.9.19). We reserve the right to withdraw this offer at any time, without notice.

ACCESS TO WEBSITE You are provided with access to the website in accordance with these terms and conditions.

You warrant that:

- the personal information that you are required to provide in order to use the website is true and accurate;
- you will notify us immediately of any changes to such personal information by contacting us. Contact details can be found at the end of these terms and conditions; and
- you agree not to impersonate any other person or entity or to use a false name or a name you are not authorised to use.

We reserve the right to modify, or withdraw, temporarily or permanently, the website (or any part thereof) without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website.

OTHER Intellectual property and right to use: You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

You acknowledge and agree that the material and content contained within the website is made available for your personal non-commercial use only and that you may (if necessary to process your gift list) download such material and content onto only one computer hard drive.

Any other use of the material and content of the website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

The website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations.Limitation of liability: While we will use reasonable endeavors to verify the accuracy of any information we place on the website or give you in person, at a wedding fair or similar event, or over the telephone, we make no warranties, whether express or implied, in relation to the accuracy of that information.

The website is provided on an "as is" and "as available" basis and we make no warranties of any kind, whether express or implied, in relation to the website, or any transaction that may be conducted on or through the website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that the website will meet your requirements or will be uninterrupted, timely or error free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represent the full functionality, accuracy, reliability of the website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the products. This does not affect your statutory rights as a consumer, nor your contract cancellation rights.

We will not be liable in contract or tort (including, without limitation, negligence) or as a result of precontractual or other representations (other than fraudulent misrepresentations) or otherwise out of or in connection with these terms and conditions for:

- Any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings)
- Any loss of goodwill or reputation
- Any special or indirect losses suffered or incurred out of or in connection with the provisions of any matter under these terms and conditions.

Nothing in these terms and conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Waiver: No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

Entire agreement: These terms and conditions govern our relationship with you and state the entire extent of your and our respective rights and obligations. Nothing in this paragraph shall limit or exclude our liability in respect of any fraudulent misrepresentation.

Governing law: The terms and conditions shall be governed by the laws of England and Wales, and you and we irrevocably submit to the exclusive jurisdiction of the courts of England and Wales in determining any dispute arising out of these terms and conditions or the Nythu gift list operation.

Browse the items on their gift list and make a purchase. Alternatively, if the couple have included a Gift Card as an option, you can contribute an amount that can be used by the couple to purchase anything on the Nythu website. If items are marked as Group Gifts, then multiple guests can contribute towards a single higher-value item.

After the wedding, the couple will place their order and the gifts will be delivered directly to them – so you needn’t worry about wrapping your gift or taking it to the wedding. Our service is free of charge to couples and their guests.

Purchase of Products: Purchase acceptance and the completion of the contract between you and us will take place on the dispatch of the products purchased to the couple unless we have notified you that we do not accept your purchase or you have cancelled it in accordance with the instructions below. If there are any problems with your purchase, you will be contacted by us using the contact details you provide. You agree to be bound by these terms and conditions when making a purchase from a gift list. Any gifts purchased will be delivered to the couple directly.

Nythu Gift Card: As well as products, couples are able to add a Nythu Gift Card option to their gift list allowing guests to pledge monies. All gift card pledges will be credited to the couples Nythu account and are only redeemable at nythu.co.uk against product gifts, and cannot be exchanged for cash. Gift card pledges are non-refundable.

If you wish to exercise your right of cancellation, the couple are obliged to retain possession of the goods and take reasonable care of them. To exercise the right to cancel, you must inform us of your decision to cancel this contract in writing including details of your name, details of the order you wish to cancel including proof of purchase and your phone number and email address. This information can be submitted by e-mail to elen@nythu.co.uk.

If you decide to cancel, we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.

We will not be held responsible if the couple do not wish to return the gift. It is your sole responsibility to arrange and bear the cost of the return of the gift and we accept no responsibility for organising this with yourself or the couple.

If the product is personal in nature and the fault is the misspelling of the personalised information, which is as a result of the couples own actions, we will be unable to replace the product.

Any gifts purchased will be delivered to the couple directly and any returns or exchanges of damaged or faulty goods will be dealt with directly with them.

We understand that some gifts are more appropriate to purchase as a group and we therefore offer a service where multiple guests can contribute towards a single higher-value item (Group Gifts). In respect of returns, Group Gift pledges are non-refundable.

Exchange of gifts by couples: In certain circumstances, couples may choose to substitute gifts with another Nythu item of equivalent value to the price paid for the gift(s) by the respective guest(s).

You agree that where such substitutions are made in respect of a gift you have selected, Nythu will have discharged its liability to you.

You further acknowledge that the primary purpose of the contract between you and us is to provide the couple with a gift of equivalent value to the amount paid by you for a product selected by the couple and subsequently substituted with agreement of the couple.

We shall be under no obligation to inform you if a substitution of the kind contemplated in this section takes place.

If, for whatever reason, an item becomes unavailable after you have purchased it, couples will have the option to substitute this item or have the equivalent value credited to their account. If this becomes necessary, we will contact the couple to discuss, but we will not inform you, the guest who purchased the item. Items substituted in this way cannot be returned unless found to be faulty, not fit for purpose or not as described.

Payment: Nythu uses “Paypal Express Checkout” to ensure the secure processing of your payment.

Payment will be taken at the time of purchase. You will receive an order confirmation via email.
